Argentina’s National Civil Aviation Administration (ANAC) published <a href="https://www.boletinoficial.gob.ar/detalleAviso/primera/323849/20250411">Resolution 265/2025</a> in the Official Gazette this Friday, establishing a new regulatory framework for the authorization and operation of aerial work in the country. The resolution repeals the previous regulation on paid recreational flights — Resolution 940/2015 — and forms part of the new Aerocommercial Market Access Regulation, approved under Decree 599/2024.The new framework aims to simplify procedures for obtaining the Aerial Work Operator Certificate (CETA) and to broaden the range of authorized activities under this certification. Notably, it eliminates the need for periodic renewals. Existing certificates will now automatically convert to a non-expiring format with no activity limitations, except as otherwise specified by current regulations.Among the most significant changes, the resolution states that any individual or legal entity may request authorization to conduct aerial work if they meet three basic conditions: they must fall under Article 48 of the Aeronautical Code, declare technical and financial capability, and, if operating foreign-registered aircraft, comply with relevant regulations. All submissions to ANAC must be made under sworn declaration.The new rules also authorize the use of experimental aircraft and drones (RPAs) for aerial work under certain technical conditions and operational limitations. In both cases, operators must notify the aviation authority at least 15 business days in advance and submit the corresponding technical documentation.The resolution further specifies that paid sightseeing flights — those that depart from and return to the same heliport or airport — are now considered a form of aerial work under the new framework. As such, a separate regulatory framework for these operations, as established under the now-repealed 2015 resolution, is no longer required.Additionally, companies already holding a valid CETA may engage in any aerial work activity listed in Article 11 of Decree 599/2024, provided they comply with specific regulations and maintain appropriate insurance coverage. They will only be required to notify ANAC before starting new activities—no new certification will be necessary.The resolution also empowers the National Directorate of Operational Safety (DNSO) to define technical conditions and limitations for certain specific activities, including those outlined in subsection k) of Decree 599/2024, which still require complementary regulation.

Argentina: ANAC updates the aerial work regulations and eliminates prior requirements for tourist flights

La Administración Nacional de Aviación Civil (ANAC) publicó este viernes en el Boletín Oficial la <a href="https://www.boletinoficial.gob.ar/detalleAviso/primera/323849/20250411">Resolución 265/2025</a>, a través de la cual establece un nuevo marco regulatorio para la autorización y operación del trabajo aéreo en Argentina. La medida deroga la normativa anterior sobre vuelos recreativos rentados —la resolución 940/2015— y se enmarca dentro del nuevo Reglamento de Acceso a los Mercados Aerocomerciales, aprobado por el Decreto 599/2024.El nuevo régimen busca simplificar los procedimientos para la obtención del Certificado de Explotador de Trabajo Aéreo (CETA), así como ampliar las actividades habilitadas bajo dicha certificación, eliminando la necesidad de renovaciones periódicas. Según lo dispuesto, los certificados actuales pasarán automáticamente a un formato sin vencimiento ni limitación de actividades, salvo las excepciones previstas por la normativa vigente.Entre los cambios más relevantes, la resolución establece que cualquier persona física o jurídica podrá solicitar la autorización para realizar trabajo aéreo si cumple con tres condiciones básicas: estar contemplada en el artículo 48 del Código Aeronáutico, declarar capacidad técnica y económica, y, en caso de operar con aeronaves extranjeras, ajustarse a la reglamentación correspondiente. Toda presentación ante la ANAC deberá hacerse con carácter de declaración jurada.La nueva normativa también habilita el uso de aeronaves experimentales y drones (RPA) para actividades de trabajo aéreo, bajo ciertas condiciones técnicas y limitaciones operativas. En ambos casos, los operadores deberán notificar a la autoridad aeronáutica con al menos 15 días hábiles de anticipación y acompañar la documentación técnica correspondiente.<section class="noteSuggested" data-id="30565" data-title="Puede interesarte"></section>Asimismo, el texto especifica que los vuelos turísticos rentados —aquellos que parten y regresan al mismo helipuerto o aeropuerto— serán contemplados como una forma de trabajo aéreo dentro del nuevo esquema. De este modo, ya no será necesario un marco normativo específico para este tipo de operación, tal como estaba previsto en la resolución derogada de 2015.La resolución también aclara que las empresas que ya cuenten con un CETA vigente podrán realizar cualquier actividad de trabajo aéreo incluida en el artículo 11 del decreto 599/2024, siempre que cumplan con las regulaciones específicas y cuenten con los seguros correspondientes. Solo requerirán notificar a ANAC antes de comenzar nuevas actividades, sin necesidad de una nueva certificación.Además, se faculta a la Dirección Nacional de Seguridad Operacional (DNSO) a definir las condiciones y limitaciones técnicas para ciertas actividades específicas, entre ellas las detalladas en el inciso k) del decreto 599/2024, que aún requieren una reglamentación complementaria.

Argentina: la ANAC actualiza el régimen de trabajo aéreo y elimina exigencias previas para vuelos turísticos

En el marco del paro nacional que afectó diversas actividades en Argentina, Flybondi informó que mantuvo su operación aérea y brindó servicios de asistencia en tierra a otras compañías en distintos aeropuertos del país.Según datos proporcionados por la empresa, hasta el momento ya se realizaron 34 de los 51 vuelos programados para la jornada, con más de 5.200 pasajeros transportados. En caso de completar el cronograma previsto, el total de personas trasladadas superará las 8.400.De todas maneras, como viene siendo habitual en Flybondi, se produjeron algunas demoras importantes en las partidas desde Ezeiza, como el vuelo FO5242 a Bariloche (cuatro horas) y el FO5102 a Tucumán (casi cinco horas).&nbsp;De acuerdo con la compañía, esto fue posible gracias a que cuenta con su propio servicio de handling, es decir, asistencia en tierra a los aviones y a los pasajeros, en el 80% de los aeropuertos donde opera. Esta capacidad le permitió continuar con su actividad durante la jornada del paro, que impactó de forma generalizada a la industria aerocomercial.Además, Flybondi detalló que prestó servicios de rampa a dos aerolíneas locales, tanto en vuelos chárter como internacionales, en los aeropuertos de Ezeiza y Santiago del Estero. The Argentine Air Navigation Company (EANA) has completed the installation of the new antenna and pedestal for the secondary radar system being deployed at Ministro Pistarini International Airport in Ezeiza, as part of a broader initiative to modernize the country’s air traffic management infrastructure.A secondary radar differs from a primary radar in that it not only detects an aircraft’s position by bouncing signals off it, but also receives additional data transmitted by the aircraft itself—such as identification, altitude, and heading. This requires the aircraft to be equipped with a transponder, which automatically responds to radar signals.The new system, which EANA says had been delayed for several years, has now been revived by the current administration.
